When you place an order, you are making an offer to purchase. Pet Jungle reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until Pet Jungle confirms acceptance. We must receive and process your payment before your order is accepted. We may be unable to accommodate cancellations after acceptance. If we do not accept, change, or cancel an order, we will attempt to notify you via the contact details provided at checkout.
Your purchases are subject to return or exchange solely in accordance with our Refund Policy.
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.
4.1 Currency & posted prices. All prices are listed in U.S. dollars (USD) unless stated otherwise. Posted prices do not include taxes, shipping, handling, customs or import charges, unless expressly stated. Promotions may be governed by separate terms.
4.2 U.S. Sales Tax / Use Tax. Under current U.S. state tax rules, because our company is based in Romania and does not maintain physical presence or economic nexus in any U.S. state, we do not collect Sales Tax on orders shipped to the U.S. (this may change if our nexus status changes). Depending on your state, you may be legally required to self-assess and remit Use Tax on out-of-state purchases. Please consult your state tax authority for guidance.
4.3 Commercial discount. To support pricing transparency, we may apply a commercial discount to list prices to partially offset any Use Tax you may owe. This discount is not tax advice and does not eliminate your individual obligations.
4.4 Nexus changes. If we later establish nexus or are required by law to collect Sales/Use Tax in your jurisdiction, we reserve the right to charge such taxes on current/future orders.
4.5 Payment. You agree to provide current, complete and accurate purchase, payment and account information for all purchases made at our stores and to promptly update such information. You represent and warrant that (i) the payment information you provide is true and complete, (ii) you are duly authorized to use such payment method, (iii) charges will be honored by your payment provider, and (iv) you will pay all charges incurred, including shipping/handling and applicable taxes, if any.
5.1 Shipping. Delivery times shown at checkout or in emails are estimates and not guarantees. Delays can occur due to carriers, customs processing, weather, or events beyond our control.
5.2 Title & risk of loss. Title and risk of loss pass to you when we deliver the products to the carrier. Claims for loss or damage in transit should be made directly with the carrier; we will reasonably assist you.
5.3 Customs & import fees (U.S.). U.S. orders may be subject to customs duties, import taxes, brokerage/clearance fees assessed by U.S. Customs and Border Protection or other authorities. These charges are your responsibility and are not included in product price or shipping charges unless stated.
5.4 Address accuracy. You are responsible for providing an accurate, deliverable shipping address. Additional reship fees may apply for incorrect addresses or refused/undeliverable parcels.
Our Services, including all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by Pet Jungle, its affiliates or licensors and are protected by applicable IP laws.
These Terms permit personal, non-commercial use only. You must not copy, distribute, modify, create derivative works of, publicly display/perform, republish, download, store or transmit any material on the Services without our prior written consent. Pet Jungle, Shopify and third-party marks are the property of their respective owners.
You may be provided with access to tools offered by third parties. We provide such tools “as is” and “as available,” without warranties or liability. Your use is at your own risk and subject to the third party’s terms. New features released later will also be subject to these Terms.
The Services may contain third-party materials and links. We are not responsible for their content, policies or practices and are not liable for any harm or damages related to your access or transactions with third parties. Review third-party terms carefully.
Pet Jungle is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Pet Jungle. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Pet Jungle, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Pet Jungle.
All personal information we collect through the Services is subject to our Privacy Policy; certain data is also processed under Shopify’s Privacy Policy. Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access and use of the Services to operate and improve them. We do not guarantee uninterrupted, timely, secure or error-free Services. Some jurisdictions do not allow certain disclaimers; those limitations may not apply to you.
TO THE FULLEST EXTENT PERMITTED BY LAW, PET JUNGLE (AND SHOPIFY) WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR LOST PROFITS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.
You agree to indemnify, defend and hold harmless Pet Jungle, Shopify, and their affiliates, officers, employees, agents, contractors and service providers from losses, damages, liabilities, claims and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, violation of law or third-party rights, or misuse of the Services.
If any provision is unlawful or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force.
Failure to enforce any provision is not a waiver. These Terms, together with policies referenced herein, constitute the entire agreement between you and us and supersede prior agreements.
You may not assign these Terms or your rights/obligations without our prior written consent. We may assign or transfer these Terms without notice.
These Terms and any separate agreements for the Services are governed by the laws of Romania (without regard to conflict-of-law rules). Courts in [TIMISOARA, ROMANIA] shall have exclusive jurisdiction and venue, except that you may bring a claim in small-claims court where you reside if permitted by law. You and we agree to first attempt informal resolution; if unresolved, disputes may be submitted to binding arbitration in [TIMISOARA, ROMANIA] under [Romanian arbitration rules]. Nothing prevents either party from seeking injunctive relief.
